OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

Participation constitutes Entrant's full and unconditional agreement to and acceptance of these Official Rules. Dotster's Next "Big" Small Business Contest (the "Contest") will begin at 12:01 a.m. Pacific Daylight Savings Time ("PDT") on July 1, 2009, and ends at 11:59 p.m. PDT on July 15, 2009 (the "Entry Period"). The Contest is sponsored by Dotster, Inc. (8100 NE Parkway Drive, Suite 300, Vancouver, WA 98662) ("Dotster"), who is solely responsible for all aspects of this Contest. Dotster's computer shall be deemed the official time keeping device for the Contest. The odds of winning depend on the number of eligible entries received.

1. ELIGIBILITY:
1. The Contest is open to current Dotster business customers (Dotster account holders) who purchased a domain or hosting account from Dotster on or before June 30, 2009 ("Customer").
2. Each Entrant must be (i) the business Customer profiled in the entry Questionnaire and/or Video, and (ii) not an individual employee of the Customer.
3. The Entrant must be a legal resident of, or domiciled in, one of the 50 United States or the District of Columbia, and must be 18 years of age or older (19 years or older in Alabama and Nebraska) at the time of entry. All natural persons making a creative contribution to, or appearing in, the Contest entry must also meet the requirements of this paragraph.
4. The Entrant must be a corporation, limited liability company, partnership or other business entity, or a sole proprietorship.
5. Entrant's business must have earned some revenue in the past 12 months.
6. Dotster and its affiliates, subsidiaries, agents, distributors, wholesalers, retailers, sales representatives, and their advertising and promotional agencies and suppliers of promotional materials, their respective employees, and their respective immediate family and household members are not eligible.
7. Internet Domain name registrars and web hosting companies, their employees, and their respective immediate family and household members are not eligible.
8. The Contest is subject to all federal, state, and local laws and regulations. The Contest is void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and otherwise where prohibited, taxed or restricted by law.
9. Only one entry is allowed per Customer.
2. HOW TO ENTER: There are two ways to enter the Contest:
1. Complete the entry Questionnaire located at www.dotster.com/nextbigssmb and submit it online during the Entry Period; or
2. Hand-write or type the words "Dotster's Next "Big" Small Business Contest," your name, address, telephone number (including area code), and email address, and provide the information required in the entry Questionnaire, specifically:
1. Business Name;
2. website(s) and domain name(s) registered or hosted with Dotster;
3. Entrant profile (150 words or less);
4. Entrant's industry (example: retail, travel, professional services);
5. year Entrant started business;
6. year Entrant started business online;
7. number of customers;
8. percent growth of Entrant's business over past 12 months (based on website traffic);
9. what is Entrant's business mission and reason for being (100 words or less); and
10. desired award: webcam or Apple® gift card.
on 8 1/2" x 11" white paper, and mail it in an envelope with first class postage affixed to the address above. All mailed entries must be received by July 15, 2009. No mechanically reproduced entries or entries submitted by facsimile will be accepted. Dotster assumes no responsibility for late, damaged, ineligible, incomplete, lost, postage-due or misdirected entries. All entries are the property of Dotster and will not be returned.

3. FINALIST PRIZES:
   Twenty (20) finalists will be chosen from the Eligible Entries to receive the Finalist Prizes (described below) on or about July 20, 2009. Entrants who are selected as potential Finalists will be contacted by email and telephone. If a potential Finalist cannot be contacted within seven (7) days after the first attempt, Dotster may select an alternate potential Finalist in his/her place from all Eligible Entries received. You are not a Finalist until (a) your eligibility has been verified, (b) you have signed the required affidavit and release, and (c) you receive official notification from Dotster that you are a Finalist. See below for further details.

4. VIDEO CONTEST ENTRIES:
   Each Eligible Entrant that is selected as a Finalist may submit a video by 11:59 PDT on August 6, 2009, in order to be eligible for the Grand Prize, Second Place Prize, or Third Place Prize ("Video"). Video Entrants must save the original Video file to provide to Dotster if selected as a Winner. The Video must meet the following criteria the to be considered for Grand Prize, Second Place Prize, or Third Place Prize:
1. Video must be no more than two (2) minutes in length.
2. The file size of the Video must be less than 500 megabytes.
3. Video must describe why Customer decided to start an online business or take a physical business online, Customer's experience with Dotster, and how Customer's online presence has helped moved the business forward.
4. Upload video to www.vimeo.com. You will be required to create an account at www.vimeo.com prior to uploading, and maintain it until all prizes are awarded. Your use of the Vimeo account is subject to all terms and conditions established by Vimeo, LLC. When uploading the Video, title it "[Your Business/Venture name] Dotster's Next Big Small Business entry" and include the tag "Dotster." Under the privacy settings on www.vimeo.com, you must set the Video to "public" so that the public is able to view and download the Video.
5. WINNERS' PRIZES:
   
   1. GRAND PRIZE. One (1) grand prize winner will be chosen from the Video entries to receive the Grand Prize (described below) on or about August 12, 2009. Finalists' odds of winning a Grand Prize depend on the number of Video entries.
   2. SECOND PLACE PRIZE. One (1) second place prize winner will be chosen from the Video entries to receive the Second Place Prize (described below) on or about August 12, 2009. Finalists' odds of winning a Second Place Prize depend on the number of Video entries.
   3. THIRD PLACE PRIZE. One (1) third place prize winner will be chosen from the Video entries to receive the Third Place Prize (described below) on or about August 12, 2009. Finalists' odds of winning a Third Place Prize depend on the number of Video entries.
   4. PRIZE VERIFICATION AND AWARDS PROCESS. Potential Grand Prize, Second Place Prize, and Third Place Prize Winners (potential "Winners") will be contacted by email and telephone. Each potential Winner must satisfactorily complete the verification process in order to win the prize indicated, subject to these Official Rules. If a potential Winner cannot be contacted within seven (7) days after the first attempt, Dotster may select an alternate potential Winner in his/her place from all eligible entries received. You are not a Winner until: (a) your eligibility has been verified, (b) you have signed the required affidavit, warranties and release, and (c) you receive official notification from Dotster of the final prize award.
   5. AWARD CONDITIONS. All prize awards are contingent upon the Entrant fulfilling all terms and conditions of these Official Rules. All potential Winners are subject to verification by Dotster, whose decision is final and binding in all matters related to the Contest. Within 21 days after the date on the initial notification letter from Dotster, each potential Winner will be required to sign an affidavit of eligibility, a warranty that all rights in the Video have been cleared and required releases obtained, and a release of liability/publicity (where permitted). If the conditions of this paragraph are not completed within the specified period, the prize will be forfeited and awarded to an alternate Winner. If any prize or prize notification is returned as undeliverable, the prize will be forfeited and awarded to an alternate Winner.
6. JUDGING:
1. Finalists will be selected by Dotster based on Entrant's Website design (appearance) (20%), Entrant's Website design (usability) (10%), creativity of Entrant's company name and domain name (10%), number of Entrant's customers (10%), percentage growth of Entrant's website traffic in the past 12 months (10%), creativity of written responses (20%) and creativity of business idea (20%). Potential Finalists will be selected on or about July 20, 2009, from all Eligible Entries received during the Entry Period. By participating, Entrants agree to be bound by the Official Rules and the decisions of the judges, which shall be final and binding in all respects.
2. Grand Prize, Second Place Prize, and Third Place Prize winners will be selected by Dotster based on Entrant's previous round score (20%), quality of Video (production values) (10%), c creativity of Video (25%), Entrant's presentation skill (15%) Entrant's ability to present a brief, clear case for its business (30%). Dotster may use the winning Video in advertising and promotion; therefore, Videos may be disqualified if they cannot lawfully be so used (due, for example, to failure to comply with intellectual property, defamation, unfair competition or advertising laws). Winners will be selected on or about August 12, 2009, from all Eligible Entries received during the Entry Period. By participating, Entrants agree to be bound by the Official Rules and the decisions of the judges, which shall be final and binding in all respects.
7. PRIZES:
1. TWENTY (20) FINALIST PRIZES: Winners may choose from either a webcam (of a brand chosen by Dotster) (retail value of $50US) or an Apple® gift card in the amount of $50.00 (US) (retail value of $50US) ("Finalist Prize"). Use of the Apple® gift card is subject to any and all terms and conditions applied by Apple® to its gift cards.
2. ONE (1) GRAND PRIZE: $1,000.00 US cash prize ("Grand Prize").
3. ONE (1) SECOND PLACE PRIZE: $500.00 US cash prize ("Second Place Prize").
4. ONE (1) THIRD PLACE PRIZE: "Honorable Mention" in Dotster's promotional materials relating to the Contest ("Third Place Prize").
5. All expenses and costs not expressly listed in the prize descriptions above are solely the winner's responsibility. Prizes are nontransferable until awarded and non-refundable and must be accepted as awarded. No cash or other substitution may be made except by Dotster. Dotster reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by Dotster in its sole discretion. All prize winners are solely responsible for all taxes associated with the receipt of any prize.
6. Prize winners who meet all of the eligibility requirements, are verified, and have fully complied with these Official Rules, will receive their prize within four (4) weeks of selection and verification.
8. GENERAL CONDITIONS:
1. Dotster assumes no responsibility for late, damaged, ineligible, incomplete, lost, postage-due or misdirected Entries. All received Entries are the property of Dotster and will not be returned.
2. Dotster reserves the right to cancel, suspend, and/or modify the Contest for any time and for any reason, including if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Contest, as determined by Dotster in its sole discretion.
3. Dotster reserves the right in its sole discretion to disqualify any individual or Entrant it finds to be tampering with the entry process or the operation of the Contest, or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law. Should such an attempt be made, Dotster reserves the right to seek damages from any such person to the fullest extent permitted by law.
4. Dotster assumes no responsibility for (i) any error, omission, interruption, deletion or defect in information, whether caused by Dotster's website, users, entrants or other causes; (ii) any theft, destruction or alteration of entries, or any unauthorized access to entries; (iii) any problem with or technical malfunction of any telephone network or telephone line, computer on-line system, server, provider, computer equipment, software; (iv) any failure or delay of any email or entry to be received by Dotster on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof.
5. Dotster's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

9. AGREEMENT TO OFFICIAL RULES:
   Your participation in the Contest constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of Dotster, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

10. PUBLICITY:
    Except where prohibited, participation in the Contest constitutes winner's consent to Dotster's use of winner's name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media worldwide without further payment or consideration.

11. OWNERSHIP OF ENTRIES:
    All intellectual property right, title, and interest in submitted Questionnaires and Videos shall remain the property of the submitting Entrant. Notwithstanding the foregoing, each Entrant hereby grants Dotster a nonexclusive, perpetual, royalty-free, fully paid, irrevocable, and worldwide license to use, reproduce, distribute, modify, have modified, create, and have created derivative works from, transfer or sublicense to others and otherwise directly and indirectly exploit the Video. By entering a Video, you represent and warrant to Dotster that (a) the Video is your original creation, (b) you have obtained sufficient copyright and intellectual property clearances to permit Dotster to exercise the license granted in this Section, and (c) you have obtained all necessary talent and location releases.

12. RELEASE:
    By receipt of a prize, Winner agrees to release and hold harmless Dotster and its officers, directors, shareholders, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Contest or the receipt or use of any prize.

13. LIMITATIONS OF LIABILITY:
    The Released Parties are not responsible for: (a) any inaccurate information, whether caused by Entrants or printing errors; (b) unauthorized human intervention in any part of the Contest; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Contest or the processing of Entries; (e) lost, delayed, misdirected, or undeliverable mail; or (f) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Contest or receipt of any prize.

14. DISPUTES:
    Except where prohibited, you agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Washington; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Contest, but in no event attorneys' fees; and (c) you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Dotster in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Washington.

15. INTERNET SWEEPSTAKES PRIVACY POLICY:
    By entering this Contest, you agree to the use of your personal information as described in the Official Rules and in Dotster's Privacy Statement located at www.dotster.com. Apple® and Vimeo, LLC, are not affiliated with Dotster or the Contest.

16. ODDS OF WINNING
    Odds of winning depend upon the number of entries received.

Washington and Vermont residents may omit return postage for Official Rules requests.
